(March 5) – Prominent Dallas-based plaintiffs’ firm Baron & Budd has expanded its operations to Washington, D.C. with the addition of Scott Simmer, Andrew Miller and Thomas Poulin.

The lawyers had been practicing at the firm Simmer started in 2014, Simmer Law Group. The new lateral hires will expand Baron & Budd’s expertise in fraud, qui tam, antitrust, third party payor litigation, health care and government fraud practice areas.

Simmer, Miller and Poulin specialize in representing False Claims Act, IRS and SEC whistleblowers who have filed claims related to health care, for-profit education and government contracting. The team also represents private insurance plans in large scale recovery actions under RICO and state consumer fraud/deceptive trade practices statutes.

“Scott Simmer is an outstanding attorney and I am please to welcome him and his team to Baron & Budd,” Managing Shareholder Russell Budd said in a statement. “This team brings a strong record of success pursuing complex litigation which closely aligns with the breadth and scope of Baron & Budd’s existing practice areas.”

Notable victories of Simmer’s group include securing a $125 million federal settlement in 2015 for the whistleblowers who brought kickback violation claims against the drug maker, Warner Chilcott; a $69.2 million judgment on behalf of a group of third party payors after a three-week trial against Mylan Labs for an anti-competitive scheme to exclude competitors; and a $16 million settlement last year against defense contractor Atlantic Diving Supply, the second largest Small Business Administration FCA settlement to date.

Asked how Baron & Budd’s physical presence in Washington contributes to the firm’s overall growth strategy, Budd said the firm focused more on the people than the geography when making this hiring decision.

“While it’s exciting to add a Baron & Budd office on the East Coast, this agreement is really rooted in the expertise and experience Scott and his team are bringing to the table,” Budd said. “Adding this group to Baron & Budd represents a tremendous opportunity for our firm to expand our existing capabilities related to highly-specialized litigation services related to fraud, qui tam, antitrust and third-party payor litigation.”

The Simmer Law Group attorneys will maintain their offices in the Watergate.
