(March 26) – Four families suing Baylor Regional Medical Center in Plano for protecting a neurosurgeon accused of killing and maiming a handful of patients now have a new obstacle in their effort to seek justice.

In an article in today’s Dallas Morning News, investigative reporter Doug Swanson writes that Abbott has filed a motion to intervene in lawsuits to make a legal argument that, if successful, would make it significantly more difficult for the victims’ families to prevail.
Abbott, who declined the DMN’s request for an interview, said in court documents that he is merely seeking to defend the constitutionality of the tort reform law passed in 2003 that requires victims’ families to prove that the hospital acted with actual intent to harm patients and not just gross negligence.
