(Jan. 7) – National labor and employment law firm Ogletree Deakins announced this week that employment litigator Gary Eisenstat has joined the firm in Dallas as a shareholder.
Eisenstat jumps over from Figari & Davenport, where he practiced for more than 30 years. He says he was attracted to Ogletree Deakins’ innovative approach to practicing law.
“The firm has experienced tremendous growth and success, is highly regarded and fits well with my practice, clients and style of preparation,” he said.
The new Ogletree Deakins shareholder says one of the developing trends in his practice is employees using personal electronic devices to conduct company business in the workplace. He says this raises a number of legal issues for employers, including protection of company trade secrets and confidential information, wage and hour issues and compliance problems.
Another trend he sees continuing to develop is the litigation arising from the use of independent contractors, rather than employees, in the workforce. He says the California class action litigation related to ride sharing services is a “perfect example” of this.
“That issue changes the entire scheme on which these services have built their business models in order to compete with other similar businesses,” he said. “Many other companies have adopted this classification model to streamline the hiring process and control costs. Yet, doing so raises many questions as the lines between employees and independent contractors blur.”
