Fifth Circuit Panel Hears Round 2 Challenge to SEC’s ‘No Admit, No Deny’ Policy

Christopher Novinger, of Mansfield, was before the Fifth Circuit for the second time on Thursday morning seeking relief from a “no admit, no deny” provision in a 2016 settlement agreement he entered with the U.S. Securities and Exchange Commission. In July 2022 a different panel of that court rejected his attempt to free himself from the gag order provision via a Rule 60(b) motion that argued the “no deny” portion of the policy violated his First Amendment and due process rights.

Crane Collapse Injury Suit Settles on Eve of Trial

A Dallas jury who heard a wrongful death case last year for the same crane collapse awarded $860 million — the second-largest Texas jury verdict in 2023 — to the parents of a woman killed. This week, companies Greystar and Bigge Crane & Rigging Co. avoided a second trial in a lawsuit brought by a man who was pinned in his car when the crane toppled onto the apartment building and parking garage.

The term “cautious optimism” may be about as cautious (and as literal) as you can get when it comes to M&A in 2024. But a survey of 200 multinational executives by Mergermarket and Norton Rose Fulbright suggests just that, even though nearly six in ten say their own appetite for M&A is likely to increase over the coming year. In fact, one in four say the overall market is likely to increase significantly. The Roundup’s Claire Poole returns this week with a detailed examination of the report, along with the usual look at recently reported deals that involved Texas firms and Texas lawyers.

  • P.S. — Barnes & Thornburg Foundation Awards $50K Grant to Dallas-Area Nonprofit - In this packed edition of P.S., we highlight the charitable giving of the Barnes & Thornburg Foundation, collectively funded by firm lawyers and staff. Each year, five firm offices are selected to direct grants to charities in their local communities. The Dallas office was chosen this year, and it awarded a $50,000 grant to Project XVI, a Dallas-area nonprofit helping children identified as belonging to at-risk communities. Their work addresses problems that most people would drive by, said Barnes & Thornburg Dallas managing partner Thomas Haskins. Read on for more about what drew the firm to Project XVI.

I assumed all lawyers were reading the likes of Kafka, Proust, and Tolstoy for fun. And after spending my days reading case law and briefs, the last thing I wanted to do was crack open Anna Karenina. So I simply didn’t read anything.

    Now I confidently crack open yet another Frieda McFadden thriller next to my insanely intellectually curious husband, who is reading yet another Dostoevsky book. Ten years ago, that might have made me self-conscious. Now it just makes me laugh.
