The whistleblowers who sued Texas Attorney General Ken Paxton say they're headed back to court unless he agrees to include in a formal agreement that the Legislature must approve their proposed $3.3 million settlement before the current legislative session ends in May.
The Texas Supreme Court is considering an opposed motion to hit pause on a whistleblower lawsuit brought by three former top aides to Attorney General Ken Paxton against the Texas AG, accusing him of firing them in retaliation for reporting to the FBI and Texas Rangers that they believed he abused the power of his office to benefit a campaign donor. One of the four whistleblowers isn’t involved in settlement negotiations and wants the lawsuit to proceed now.
In a nine-page response to a request from the whistleblowers to lift an abatement in the case after they alleged a bait-and-switch on the $3.3 million settlement deal, the Office of the Attorney General told the Texas Supreme Court the case should stay paused while the Legislature considers approval.

In a brief on the merits filed Wednesday, the Office of the Attorney General argued a whistleblower lawsuit brought against him by former high-ranking attorneys in the office should be dismissed because the Texas Whistleblower Act doesn't apply to him. Carlos Soltero of Soltero Sapire Murrell, who represents one of the whistleblowers, told The Texas Lawbook he's confident the Texas Supreme Court — like the Austin Court of Appeals panel and a Travis County District Court judge who have allowed the case to move forward — will find no merit in the argument.
