Key Considerations for a Texas Privacy Law

In 2020, California became the first US state to pass a comprehensive privacy law in the mold of the EU General Data Protection Regulation. More and more states appear ready to enact similar laws. Texas is no exception. To guide the 87th Legislature and prepare Texas general counsel for what is likely to come, this article examines the CCPA, the GDPR, and other comprehensive privacy laws to highlight four key considerations that the Legislature will likely take into account in drafting a comprehensive Texas privacy law. Texas Supreme Court: Is Facebook Immune from Claims It ‘Failed to Warn’ Teen Rape Victims?

Lawyers for three Texas teenagers who were targeted by sexual predators on Facebook, raped and forced into sex trafficking told the Supreme Court of Texas Wednesday that a federal law protecting social media sites from defamation litigation should not shield them their duty to warn and protect minors using its website. The case is being monitored by legal experts nationwide. A win for the plaintiffs could open the floodgates for litigation against Facebook and other social media outlets brought by victims of sexual predators across the country.

The Texas Supreme Court is weighing a 2016 dispute brought by Panda Energy against ERCOT that could decide if the quasi-governmental non-profit corporation power grid operator should be protected from civil lawsuits via a cloak of sovereign immunity. The Houston Chronicle has details.

Power Outage Lawsuit Avalanche Coming

A dozen lawsuits against ERCOT and four Texas energy companies have already been filed and hundreds more are expected as a result of the winter storm-induced power outages. The initial lawsuits are by individuals, but legal experts say that the biggest cases – those pitting energy companies against each other over contract breaches – are several months away from being lodged. U.S. District Judge Alan Albright’s second patent trial is underway in Waco. Monday afternoon, jurors heard from two of the country’s premier trial lawyers about the backstories of their sparring clients, VLSI and Intel. The takeaway? Intel either knowingly made a billion products that infringe on VLSI’s patents or Intel engineers were too caught up in their own innovations to know of their existence.

  • Navy Veteran-Turned Lawyer Takes on VA Policy That Denies Education Benefits - Luke Schamel became an officer in the U.S. Navy to serve his country. Now a Houston associate at Yetter Coleman, Schamel is continuing his public service in a different uniform. He is representing the Veterans of Foreign Wars on a pro bono basis in a lawsuit against the U.S. Department of Veterans Affairs that challenges a rule that petitioners say denies veterans the full education benefits that they have earned.

    At the center of the case is the VA’s “break-in-service” rule, which petitioners argue improperly requires veterans to have a gap in military service before they can access the full 48 months of education benefits available under the Montgomery GI Bill and the Post-9/11 GI Bill.
