UPDATE – Texas Courts Find More Businesses Violating Workers’ Wage and Hour Rights

Wage-and-hour lawsuits filed against Texas businesses have increased 41 percent during the past three years and more than tripled over the past decade, according to research by Androvett Legal Media.

“The number of calls I get from potential clients with viable wage and hour cases are more than I have the time and resources to accept,” said Baron & Budd’s Allen Vaught, who recently won two major cases against companies under the U.S. Fair Labor Standards Act.

An in-depth examination by The Texas Lawbook finds the tidal wave of wage-and-hour lawsuits against Texas companies is not likely to end soon for one reason: workers are winning in court.

Flaming Well Case Tests Texas Anti-SLAPP Law

Video of a Parker County man igniting his water well in flames could help define the reach of a 2011 Texas law designed to protect citizens engaged in public discourse from retaliatory lawsuits.

The Texas Supreme Court heard arguments Thursday in a case of first impression involving the Texas Citizens Participation Act, which was designed to allow trial courts to quickly dismiss so-called strategic lawsuits against public participation, or SLAPP suits, filed by businesses attempting to use the courts to intimidate and silence their public critics. UPDATED – Judge Orders Life Partners, Executives to Pay $46.9 Million

An Austin federal judge ordered Waco-based Life Partners Holdings and its CEO and general counsel to pay $46.9 million for violating securities laws. In a scathing, 22-page order, U.S. District Judge James Nowlin made statements that surprised lawyers for both Life Partners and the Securities and Exchange Commission, which brought the lawsuit in 2012.   • P.S. — ‘Our Bar Card Is Not Merely a Ticket to a Better Bank Account,’ Retired Fifth District Court of Appeals Justice Kenneth Molberg Says Accepting Dallas Bar Foundation Award - In this edition of P.S., retired Fifth District Court of Appeals Justice Kenneth Molberg urged lawyers to defend the rule of law and ensure their efforts extend beyond the privileged to those most in need, while accepting the Dallas Bar Foundation’s 2026 Fellows Justinian Award.
